1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of spanishtable.com (the “Site”) and any purchases you make. By accessing or using the Site, creating an account, or placing an order, you agree to be legally bound by these Terms and our Privacy Policy (incorporated by reference). If you do not agree, please do not use the Site.
We may update these Terms from time to time. Changes are effective when posted with the “Last updated” date above. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

3. Eligibility and Accounts
You must be at least 18 years old (21 for alcohol purchases) and capable of entering a binding contract to use the Site. If you create an account, you agree to: (a) provide accurate, current, and complete information; (b) maintain and promptly update it; (c) keep your password confidential; and (d) accept responsibility for all activities under your account. Notify us immediately of any unauthorized use.
4. Products, Pricing, and Orders
4.1 Product Information
We strive for accuracy, but descriptions, images, pricing, availability, vintages, and packaging may contain errors or may be updated without notice. We may limit quantities or discontinue products at any time.
4.2 Prices and Taxes
Prices are in U.S. dollars and exclude shipping, handling, and applicable taxes unless otherwise stated. We reserve the right to correct pricing errors, and to cancel orders that reflect an obvious error, even after submission or confirmation (a full refund will be issued if payment has been captured).
4.3 Order Acceptance
Your order is an offer to buy. We may accept or reject any order for any reason (e.g., out of stock, pricing error, suspected fraud). If we cancel after charging you, we will issue a full refund to your original payment method.
4.4 Payments
We accept the payment methods shown at checkout. By submitting payment information, you represent that you are authorized to use the chosen method and authorize us (and our payment processors) to charge the total amount. If payment fails, we may cancel your order.
5. Shipping, Delivery, and Risk of Loss
We ship via third-party carriers (e.g., UPS, USPS, FedEx). Shipping times are estimates, not guarantees. Title and risk of loss pass to you upon our delivery to the carrier. You are responsible for providing a valid, secure delivery address and for any additional fees, including re-delivery or address correction.

7. Alcohol Compliance (California)
You must be 21 or older to purchase alcohol. By ordering alcohol, you affirm you are 21+ and that the recipient is 21+ and will present valid, government-issued photo ID at delivery. An adult signature is required. We reserve the right to refuse or cancel alcohol orders if we cannot verify age.
8. Consumer Protections (California and U.S.)
- You are entitled to clear, accurate pricing and material terms prior to checkout.
- You may cancel recurring subscriptions in your account or by contacting us (see Section 12).
- You are entitled to products that conform to their descriptions and are fit for ordinary purposes.
- Defective, damaged, or misdescribed items may be eligible for refund or replacement under our policies and applicable law.
- We comply with California and U.S. consumer protection laws, including privacy laws referenced in our Privacy Policy.
Non-waivable rights: Nothing in these Terms limits any consumer rights that cannot be waived under California or U.S. law.
9. Intellectual Property
All content on the Site—including text, images, graphics, logos, and software—is owned by or licensed to The European Table dba The Spanish Table and is protected by U.S. and international intellectual property laws. You may use the Site for personal, non-commercial purposes only. Any reproduction, distribution, modification, or derivative use requires our prior written consent.
If you submit content (e.g., reviews), you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, publish, translate, distribute, and display such content in connection with our business in any media.
10. Prohibited Uses
You agree not to: (a) violate any law or regulation; (b) infringe others’ rights; (c) engage in fraud, deception, or harmful conduct; (d) interfere with or disrupt the Site; (e) use bots, scrapers, or automated means without permission; (f) collect personal data of others without consent; or (g) attempt to circumvent security or access controls.
11. Disclaimers and Warranties
Except as required by law, the Site and all products are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
Some jurisdictions (including California) do not allow limitations on implied warranties, so the above may not fully apply to you.
12. Automatic Renewal / Subscription Terms (California ARL)
If you enroll in a wine club or other recurring subscription (each a “Subscription”), the following terms apply in compliance with California’s Automatic Renewal Law (ARL):
- Clear Disclosure: Before you complete sign-up, we will clearly present the renewal frequency, ongoing charges, and how to cancel.
- Affirmative Consent: You must affirmatively consent (e.g., by checking a box) to the automatic renewal terms before purchase.
- Acknowledgment: After enrollment, we will email you an acknowledgment stating the terms, cancellation policy, and how to cancel.
- Recurring Charges: Your authorized payment method will be charged on a recurring basis until you cancel. Taxes and shipping (e.g., adult signature for alcohol) may apply.
- How to Cancel: You may cancel at any time before the next billing by (a) logging into your account and turning off auto-renew, or (b) emailing wineclub@spanishtable.com or customerservice@spanishtable.com with your name and order/club details. We provide a cost-effective, easy-to-use, and timely online cancellation method.
- Material Changes: If we make material changes to renewal terms, we will notify you in advance and obtain your consent as required.
13. Limitation of Liability
To the fullest extent permitted by law, we (and our affiliates, officers, employees, and suppliers) are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages (including lost profits, goodwill, or data) arising from or related to your use of the Site or products. Our total aggregate liability for any claim shall not exceed the greater of (a) the total amounts you paid to us in the 12 months preceding the claim, or (b) $100.
Some jurisdictions (including California) do not allow exclusion of certain damages; some limitations may not apply to you.
14. Indemnification
You agree to indemnify, defend, and hold harmless The European Table dba The Spanish Table and its officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms, violation of law, or misuse of the Site.
15. DMCA Notice
If you believe any content on the Site infringes your copyright, please send a notice to our designated agent with: (i) identification of the copyrighted work; (ii) identification of the allegedly infringing material; (iii) your contact information; (iv) a good-faith statement; and (v) your signature.

16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in San Francisco County, California. Before filing any action, both parties agree to attempt in good faith to resolve disputes through direct communication.
17. Severability and Waiver
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. No waiver of any provision shall be effective unless in writing, and no waiver shall be deemed a further or continuing waiver of such term or any other term.
18. Termination
We may suspend or terminate your access to the Site (or your account) at any time, with or without notice, for violation of these Terms, fraud, abuse, or any other reason. Upon termination, all rights granted to you under these Terms will immediately cease.
19. Notices
We may provide notices via email, Site banners, or other reasonable means. Notices are effective when sent. You are responsible for keeping your contact information current.
20. California Consumer Affairs Notice

21. Entire Agreement
These Terms, together with our Privacy Policy and any other policies posted on the Site (including shipping and returns policies), constitute the entire agreement between you and The European Table dba The Spanish Table regarding your use of the Site and purchases, and supersede all prior agreements or understandings on the subject matter.
